Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Parity mobile application and related services ("Service") provided by Parity Talk ("Parity," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may change these Terms at any time by notifying you, and your continued use of the Service following such an update will represent an agreement by you to be bound by the Terms as amended.

1. Eligibility

By accepting these Terms, you represent and warrant that:

You have the legal capacity and authority to enter into a binding contract with us
You are authorized to use the payment method you provided when purchasing a Subscription
You are either over the age of 18 and accessing the Service for personal use, or you are accessing the Service on behalf of someone under the age of 18 and consent to that person's use of the Service

The Service is not intended for unsupervised use by any person under the age of 18. Please do not access the Service if you are under 18 and do not have your parent or guardian's consent, or if you have previously been suspended or prohibited from using the Service.

2. Description of service

Parity is an AI-powered communication tool that helps users translate and understand communication between different neurological profiles ("neurotypes"). The Service includes:

A Translate mode that rephrases communication for specific recipients based on their neurological profile and communication patterns
A Talk mode that provides conversational support for processing communication situations
Connection profiles that store information about people you communicate with
A learning system that improves translations based on conversation history and outcomes
Cloud backup via Sign in with Apple for cross-device data restoration

3. Disclaimer — not medical or professional advice

This section is critically important. Please read carefully.

While the Parity application has been designed to help bridge communication differences between neurotypes using advanced AI, you acknowledge and agree that:

Not medical or professional advice. Any information provided to you through the Service is general in nature, may not be suitable for your circumstances, and does not constitute medical, psychological, financial, legal, or any other kind of professional advice.
Not therapy or counseling. Parity does not provide mental health treatment, psychological counseling, or therapeutic intervention of any kind. It is not a substitute for a licensed therapist, psychologist, psychiatrist, or counselor.
Not a crisis intervention system. Parity is not designed to handle mental health emergencies, suicidal ideation, self-harm, abuse situations, or any other crisis. If you or someone you know is in crisis, contact the 988 Suicide & Crisis Lifeline (call or text 988), Crisis Text Line (text HOME to 741741), or your local emergency services (911).
Not a diagnostic tool. Parity does not diagnose neurodevelopmental conditions, mental health disorders, or any other condition. Neurotype selections are self-reported and used only for communication personalization.
Not a substitute for professional communication support. Parity does not replace speech-language therapy, augmentative and alternative communication (AAC) systems, social skills training, occupational therapy, or any other professional intervention.
Requires clear user input. The Service requires clear and coherent user input to ensure effective responses. The quality and appropriateness of translations depend on the accuracy and completeness of the information you provide.
Compliance with laws. It is your responsibility to comply with applicable laws relevant to your use of the Service, including privacy laws when providing information about other individuals.

4. AI-generated content

All translations, coaching responses, explanations, suggestions, and learned patterns provided by Parity are generated by artificial intelligence (Anthropic's Claude language model). You acknowledge and agree that:

AI can be wrong. Translations and suggestions may be inaccurate, inappropriate, or counterproductive in specific situations. AI cannot fully understand the nuances of every human relationship, cultural context, or individual circumstance.
Translations are suggestions, not scripts. You should always use your own judgment before using any translation. The app provides options — you decide what to say.
Learned patterns may be inaccurate. AI-generated summaries of communication patterns are inferences based on limited data. They may contain errors. You can and should edit these summaries when they are incorrect.
No guaranteed outcomes. Parity cannot guarantee that any translation or suggestion will produce a desired outcome. Human relationships are complex and no AI tool can account for every variable.
You are responsible for your words. You are solely responsible for what you choose to say to others, regardless of whether you used Parity to help phrase it.

5. Acceptable use

You must comply with these Terms at all times. You must not, and must not encourage or permit any third party to:

Upload sensitive personal information of others without their consent, in particular any information that goes against our Privacy Policy and Generative AI Use Policy
Upload any inappropriate, offensive, illicit, illegal, pornographic, sexist, homophobic, or racist material
Use the Service for any purpose other than improving interpersonal communication
Use the Service to generate harmful, abusive, threatening, harassing, or illegal content
Use the Service to manipulate, deceive, or psychologically harm others
Use the Service as a substitute for professional medical, psychological, or therapeutic care
Use the Service in any situation involving imminent physical danger, abuse, or crisis
Make copies of, adapt, modify, or tamper with the Service
Remove or alter any copyright, trademark, or other notice on the Service
Decompile, reverse engineer, or attempt to derive the source code, AI prompts, system instructions, or algorithms of the Service
Sell, loan, transfer, sublicense, hire, or otherwise dispose of the Service to any third party
Share your Account or Account information, including login details, with any other person
Make any automated use of the Service
Attempt to circumvent any technological protection mechanism or security feature of the Service

If you are providing personal information about another individual (such as creating a connection profile), you warrant that you have the informed consent of the relevant individual, or that you are providing the information in your capacity as their parent or legal guardian.

6. Account and authentication

You may use Parity without creating an account. If you choose to sign in with Apple:

You are responsible for maintaining the security of your Apple ID
You are responsible for all activity under your account
Cloud backup is optional — the app functions fully with local-only data storage
You must immediately notify us of any unauthorized use of your account
We may, in our discretion, suspend or terminate your account at any time

7. Subscriptions and payments

7.1 Free tier

Parity offers a free tier that includes 5 translations per month, 2 Talk sessions per month, 1 connection, and full memory functionality. The free tier is provided at our discretion and may be modified at any time with notice to you.

7.2 Parity+ subscription

Parity+ is available as a monthly subscription ($5.99/month), annual subscription ($39.99/year), or lifetime purchase ($99.99 one-time). Parity+ includes unlimited translations, unlimited Talk sessions, unlimited connections, and voice input.

7.3 Payment and renewal

Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID account settings
All Subscription Fees are paid in advance and are non-refundable for change of mind

7.4 Lifetime purchase

The lifetime purchase grants you access to Parity+ features for the lifetime of the Parity product. "Lifetime" refers to the lifetime of the Parity app, not the lifetime of the purchaser. If Parity is discontinued, no refund is owed for lifetime purchases.

7.5 Price changes

We reserve the right to change subscription prices at any time. Price changes will not affect existing active subscriptions until renewal. We will provide at least 10 days' notice of price changes. If you do not cancel before new prices take effect, you accept the new pricing.

8. Your content

8.1 Warranties

By providing any information, material, or content in connection with the Service, you represent and warrant that:

You are authorized to provide the material
The material does not breach our Privacy Policy or Generative AI Use Policy
The material is accurate and true at the time it is provided
The material is free from any harmful, discriminatory, defamatory, or maliciously false content
The material does not infringe any intellectual property rights of any third party
The material does not contain any viruses or harmful code
The material does not breach any applicable laws

8.2 License

Content you create (profiles, connection descriptions, conversation text) remains yours. By using the Service, you grant us a limited, non-exclusive, royalty-free license to process your content through our AI systems solely to provide the Service to you. We do not use your content for any other purpose, including training AI models.

9. Intellectual property

We retain ownership of all materials provided to you in connection with the Service (including text, graphics, logos, design, icons, images, software, AI prompts, and system instructions) and reserve all rights in any intellectual property rights owned or licensed by us. You may not copy, modify, distribute, sell, or lease any part of the Service.

10. Notice regarding Apple

If you access the Service from the Apple App Store, you acknowledge and agree:

This agreement is between you and Parity Talk, not Apple. Apple is not responsible for the Service or any content available through the Service.
Apple has no obligation to furnish any maintenance or support services for the Service.
In the event of any failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the Service.
Apple is not responsible for addressing any claims relating to the Service, including product liability claims, regulatory compliance, or consumer protection claims.
In the event of any third-party intellectual property infringement claim, Apple is not responsible for investigation, defense, settlement, or discharge.
Apple and its subsidiaries are third-party beneficiaries of this agreement and have the right to enforce it against you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARITY TALK SHALL NOT BE LIABLE FOR:

Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
Any consequences of communication you engage in using suggestions, translations, or advice provided by the Service
Any inaccuracies, errors, or omissions in AI-generated content, including translations, explanations, learned patterns, and coaching responses
Any harm, emotional distress, relationship damage, or other negative outcomes resulting from reliance on the Service
Any loss of data, whether stored locally or in cloud backup
Any unauthorized access to your account or data
Any interruption, suspension, or termination of the Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

YOU EXPRESSLY ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY BE INACCURATE AND THAT YOU USE THE SERVICE AT YOUR OWN RISK. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Parity Talk, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of any third party
Any content you provide to the Service
Any communication you engage in using suggestions from the Service
Any third-party intellectual property infringement related to content you provide

13. Data hosting and security

We may store data using third-party cloud services, including servers located outside your country of residence. While we will use our best efforts to select appropriate hosting providers and ensure data is stored securely, we do not guarantee that hosting services will be free from errors or that data will be accessible at all times. We do not accept liability for any unauthorized use, destruction, loss, damage, or alteration to data due to hacking, malware, or other interference.

14. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.

15. Dispute resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules, conducted in the State of Florida. You agree to waive any right to a jury trial and to participate in a class action lawsuit.

A party claiming that a dispute has arisen must provide the other party written notice containing reasonable details of the dispute. Each party must use its best efforts to resolve the dispute in good faith within 14 days. If the dispute is not resolved within that period, either party may proceed to arbitration.

16. Termination

16.1 Termination by either party

Either party may terminate for convenience at any time. You may cancel your subscription through your Apple ID account settings.

16.2 Termination for breach

We reserve the right to terminate or suspend your access to the Service immediately if you breach these Terms.

16.3 Effect of termination

Upon termination: you will no longer have access to the Service or your Account; we will have no responsibility to store or retain any data (unless required by law); any subscription fees already paid will not be refundable; and sections 3, 4, 8, 9, 11, 12, and 15 survive termination.

17. Force majeure

We will not be liable for any delay or failure to perform our obligations if such delay or failure arises from events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, government actions, power failures, internet outages, or third-party service disruptions.

18. General

Governing law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Entire agreement: These Terms, together with the Privacy Policy and Generative AI Use Policy, constitute the entire agreement between you and Parity Talk.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
Waiver: Our failure to enforce any provision does not constitute a waiver.
Assignment: You may not assign your rights. We may assign ours without restriction.
